The Justice Department last week filed a petition for certiorari (full text) in Trump v. State of Hawaii, a challenge to the President’s third travel ban.  In the case, the U.S. 9th Circuit Court of Appeals held that the third version of President Trump’s travel ban is inconsistent with the Immigration and Nationality Act. (See prior posting.)  The 9th Circuit avoided deciding the question of whether the Proclamation violates the Establishment Clause.
